As we discussed in the Board meeting of April 12, 2023, Sierra Crest has been facing some serious financial problems which require a fundamental look at the way the HOA is run and how decisions are made. We believe the core of the problem is the way the governance was set up from the beginning which was developer centered and then Board centered. But nearly 50 years after Sierra Crest was founded, we are now a mature community with 50 home owners and 60 lot owners. We need to re-examine the way things are run and how decisions are made. Our goal is to fix the financial problems from the core for the long-term, not just simply by raising dues. We will attempt to to do this in 3 steps:
1.) By adopting common-sense timeless principles that will re-establish financial integrity and shift the power of major decision making from the Board to the Members. These will be adopted as part of our Bylaws and Declaration and replace outdated items.
2.) We will create Committees made up of Board Members and Volunteers who can look for potential solutions that are practical, and will help improve the quality of life at Sierra Crest.
3.) Third, we will analyze solutions that the Board and Members propose, and will hold a vote on those that the majority wants to implement. NOTE: This will NOT be done at this meeting. That will be discussed at a future meeting once we have time to understand the problems and look at potential solutions.
Our intent with this meeting and other special member meetings in the near future is to involve the entire community and to work to adopt the following potential changes to our bylaws and declaration which will require 67% YES vote.
The Amendments we will be discussing are the following:
1. Adopt a Balanced Budget Amendment
2. Change in HOA Dues Requires Member Approval
3. Annual Budget Requires Member Approval
4. One Time or Special Purpose Capital Expenditures Over $10,000 Require Member Approval
5. Clear HOA Dues Payment Policy All Members Must Sign
6. Delinquent Collections Policy
7. End Free Lot Policy
8. Transparent Communications Policy
9. Major Board Decisions and Actions Policy
10. Reinstate Annual Discount or Rebate Policy
Some of these committees already exist, but typically are made up of 1 board member. Our goal is to create permanent committees made up of 1 board member and minimum 2 volunteer members who will commit to serve for 1-year terms to help us manage Sierra Crest for the benefit of everyone and to provide accountability focused on results. Other committees are new that we would like to create and find people who will want to participate on them.

1.) Committee Assignments - We will be selecting who will head up each committee and seeking volunteers who want to join each committee.
2.) Discuss Delinquencies and Collection Efforts - We will be discussing the progress made to date on collections and deciding whether to continue using Cagle Pugh to pursue delinquent accounts given the progress made and the costs to pursue legal action.
3.) Options to Invest Reserves at Higher Interest - We will be exploring options where Sierra Crest can earn a higher yield on its reserves.
4.) Discuss Restrictive Covenant Violations - We will be discussing two cases that were referred to Cagle Pugh and whether the Association wants to pursue litigation.
5.) Review Past Meeting Minutes - We will be reviewing and approving the meeting minutes for the last 3 meetings so they can be sent to members and added to our records.
6.) Financial Update - We will be providing a brief update of income and expenses to date, cash position, and efforts to cut costs.

The Legal Committee, appointed by the Sierra Crest Board of Directors, has prepared this ballot as a way to vote on amending the current Declaration and Bylaws so as to achieve the following:
1.) To better reflect the will of the Members as to how their dues should be determined and allocated
2.) To help implement better financial discipline and controls guided by sound principles
3.) To establish more checks and balances between Members and Boards
4.) To bring our guiding documents in line with current law and
5.) To better reflect the state of a community that has now been established for nearly 50 years.
The hurdle to amend the Declaration require 67% or 75 votes to pass amendments. The hurdle to amend the Bylaws require 51% or 57 votes to pass amendments.
For this reason, we are requesting that everyone participate in this election and make your voice heard - either in person, by absentee ballot, by proxy, or via electronic ballot.At this time we are sending the PDF ballot you will be receiving in the mail. You can print this out and bring it to the meeting, drop it off at Dana Properties, or you can submit your signed ballot to this email. In a separate email we will be sending out a PDF form that you can fill out and sign electronically if you wish to do it that way also.

3. Access to 1305 E. Robinson lot for sale
There is a lot outside Sierra Crest's entrance at the corner of Sierra Crest and E. Robinson that recently went on the market for sale. The realtor and some buyers have inquired if Sierra Crest is willing to put in writing that the buyer will have access to that lot. That would require destroying part of our entrance on the left hand side. The owner/landlord is arguing they should have right of way. Sierra Crest is arguing adverse possession.
4. Plan to implement collections on members who are behind on dues using new guidelines
As of August 31, 2023 there were 25 lots that were behind on dues. Some as little as $240 and others as much as $6,959. The total due to Sierra Crest is $25,828. With the new policies that were adopted at the September 12, 2023 meeting, the Board is tasked to implement this policy of collections in a consistent manner. The goal will be to bring this balance down to as close to $0 as possible by either getting members to sign up for automatic withdrawals or a payment plan. There are at least 10-15 of those where that would most likely fix the problem. The larger amounts - an effort needs to be made to reach out to those owners to encourage them to pay off their balance or enter an official payment plan so the Board does not have to resort to implementing the policy of having to refer these accounts to an attorney for collection.
5. Guard Station Committee - meet to discuss ways to increase security and lower expenses
We will assemble a guard station committee made up of both Board Members and Volunteer Members who will take a look at ways of increasing security while reducing ongoing costs for the community. This committee will be tasked with considering the following:
a.) Considering an enhanced security camera system to purchase to monitor all streets in the community
b.) Considering installing a metal gate at the entrance
c.) Considering reducing the number of guard shifts at the entrance
d.) Considering employing the guards directly rather than outsourcing them
All of these measures must be looked at individually and as a whole as a way of seeing the pros and cons with the goal of increasing security while reducing expenses, which could lead to lower monthly dues for everyone.
6. Discuss resolutions needed to establish new reserve account at PNC Bank
PNC was unable to open the bank account because they said we are missing a few key documents. We need to establish the appropriate resolutions and meeting minutes to be able to open it.
